I was recently quoted in an article published by Danish television network TV 2 Danmark examining the lawsuit between the State of Nevada and prediction market platform Kalshi.
The case raises an important legal question: whether contracts allowing people to trade on the outcomes of sporting events should be regulated as gambling under state law or as financial derivatives under federal commodities law.
The article discusses how this case could influence the future regulation of prediction markets and sports betting in the United States. I also commented on the significant barriers new companies face when attempting to enter the sports betting industry, which is already dominated by large, established operators.
